CNA: Dheryneia crossing point cannot open unilaterally
The crossing point at Dheryneia cannot be opened unilaterally by the Turkish side, which so far has not implemented what was agreed about the opening, ie. to remove a manned Turkish military post from the area, sources told the Cyprus News Agency.
Turkish Cypriot newspapers have been reporting lately that the works in the crossing point were concluded and the opening will take place on Monday, however for this to happen, the United Nations need the consent of both sides. The Greek Cypriot side, which has completed the works needed for the opening a long time ago, made it clear that only by moving the Turkish post, the crossing point can start operating.
“If they move the post, as it was agreed, yes, the crossing point can be opened tomorrow,” the same source told CNA.
CNA contacted the UN on Friday which said that neither side has informed the UN peace-keeping force in Cyprus (UNFICYP) that they are opening the crossing point in Dherynia. This was reiterated today. “There hasn`t been any change in the situation,” a UN source told the agency.
Mayor of Dheryneia, Andros Karagiannis, with whom CNA spoke today, repeated once again that the Greek Cypriot side has been ready for the opening of the crossing point and that the work which was pending in the buffer zone, has also been completed. He said that on Friday he had a meeting with the UN who briefed him that they know nothing about the opening on Monday and that both the Greek Cypriot side and the Turkish Cypriot side have not told them anything officially.
Karayiannis said that on Friday works were underway by the Turkish Cypriot side and added that most probably what is going to happen tomorrow, is that these works will be completed.
According to a communique issued in May 2015 by President Anastasiades and Turkish Cypriot leader Mustafa Akinci, the Technical Committee for Checkpoints was instructed to proceed with the opening of more checkpoints, starting with Lefka/Aplici on the northwest and Dherynia in Famagusta district, on the east.
An agreement is also pending for the opening of the old Aglantza (Nicosia)-Athienou road as well as the Pyrgos-Pahiamos road.
In the past several years, many crossing points have opened to facilitate the movement of people to and from the island’s northern Turkish occupied areas.

Still a hive of activity: St Paul’s Anglican Cathedral in Nicosia is 125
WHEN Disraeli, the Prime Minister of Great Britain, and Queen Victoria’s favourite politician, gained financial control of the Suez Canal, he needed a base where he would ensure the safety of his investment.
He had yet to occupy Egypt, so he entered into an extraordinary arrangement with the Ottoman Sultan— regarded by many as ‘the sick man of Europe—to take on the administration of Cyprus for an annual tribute of £92,800 which gave the British Empire military control of the eastern Mediterranean and a Marshall presence in the Middle East.
However, where the British tread in a foreign field, there follows the Anglican Christian Church. The Monarch defends the faithful and ensures the presence of ministers to fulfill the services necessary to sustain religion among the righteous that gather together to worship, christen the children, conduct the office of matrimony, and bury the dead.
In 1878, when the British troops arrived in Larnaca, very few among the administration believed that there was anything permanent in the occupation, and as Disraeli had made no provision for financial support, and the troops were dropping by the minute from heat stroke and malaria, it fell to the church to give moral and religious support to these strangers in a very strange land.
The relationship between the Anglican clergy and the Orthodox was not good and it was the Muslims that provided a roof for the two priests sent to the island in a house close to Paphos Gate –Lieutenant Kitchener, church warden — all services were overseen by Reverend Dr. Finlay and conducted in the house of the Reverend Josiah Spencer who paid a rent of about £33 a year for the Bedestan.
The good Josiah had signed a lease on the premises but discovered that under Islamic Law no other place of worship could exist within 60 metres of a mosque, and his dwelling was in the Bedestan 10 metres from the magnificent Ayia Sophia—now a mosque— a centre of worship for the Muslims.
Enough money was raised to build a new church on St. Georges Hill opposite the Secretariat at a cost of £1,200 and to be known as St Paul’s. The first service was held on Christmas Day 1885.
Two years later the parish minutes record cracks appearing and that a subterranean movement was damaging the church and surrounding buildings and it was decided to rebuild the church on its present site donated by the High Commissioner, Sir Henry Bulwer.
The building committee dismantled the old church and moved it by donkey and camel cart to the ground of the current Cathedral which was built in the Victorian Gothic style with a nave and four bays, a square chancel, a bell tower and a vestry. The church was consecrated in 1893 by The Bishop of the Church of England in Jerusalem and the foundation stone laid by Lady Sendall. The church was re-hallowed as a Cathedral Church by The Right Reverend Leonard Ashton, first Bishop in Cyprus and the Gulf on May 1981. His first text being Acts, 13: 4-5 the story of Paul and Barnabas coming to Cyprus. Over the years the Cathedral has expanded to its current comfortable size.
On October 6, to mark the 125th anniversary of the foundation of the Cathedral The Very Reverend Jeremy Crocker, Dean of St. Paul’s will hold a reception in the Cathedral Hall and assist the Right Reverend Michael Lewis, Anglican Bishop in Cyprus and the Gulf at Choral Evensong and on the dedication of a new stained glass window— celebrating the epiphany of Paul on the road to Damascus— in the cathedral on Sunday October 7 at 3pm.
The window was created by the artist Kath Wilson whose studio ‘One Offs’ is based in Cornwall.
The Cathedral is the centre of Anglican religious activity in the capital, constantly engaged in fund-raising events. It has a bookshop that is open every Saturday morning and in other parts of the grounds, once the Deanery gardens, the lady volunteers, sell at very reasonable prices, clothing, shoes, household materials, electrical appliances and every kind of second-hand sports equipment. The parish council organise fayres, readings, quizzes and whist drives. The Cathedral provides a focus for real Christian activity that is rarely encountered in this modern era.
Many of those responsible for the success of the Christian Community are buried in the English Cemetery in Nicosia, which is also a Commonwealth War Grave and is open every day of the week.
It is expected that Demetris Syllouris, speaker of the Cyprus Parliament will attend the ceremony along with British officials.

Interference with the right of access
Actions aiming to reverse or abolish the right of access are considered to be illegal violating the right of possession of a property and the owner of the dominant property in favour of which the right of access works is protected on the basis of the civil offence of unlawful interference and nuisance. Similar protection is also enjoyed by the owner of the servient property in the event of any actions by the owner of the dominant property which prevent him from using the right of access.
The right of access is an easement recognised as immovable property, which may not be recognised as such in the law regarding civil offences, but a breach of the right of possession constitutes the civil offence of unlawful interference and nuisance.
The distinction between the two offences is only theoretical, since the remedies which the Court may grant, depending on the nature of the intervention, are the same, consisting of the issue of an order to restore the right of access to the state in which it was prior to the illegal interference.
The right of access which is registered both in the land registry and the title deed of the dominant and the servient property, is not an independent property right. Its granting is linked to the ownership of the dominant property which expands and it constitutes a burden limiting the right of ownership of the servient property.
The rights of the owner of the dominant and the servient property were examined by the Supreme Court in its judgement issued in C.A. 217/2017 dated 10.9.2018, stating that it is an interesting issue in the field of the rights surrounding immovable property, especially the right of access.
The case concerned an appeal against a first instance judgment whereby the Court issued orders against the owner of the dominant property to demolish the wall he had constructed on part of the servient property not covered by the right of access, as well as to demolish the wall constructed within the right of access up to a height of 30 cm from the asphalt surface of the passage access and to remove any obstacle preventing the use of the access by the owner of the servient property.
Referring to case law, the Supreme Court pointed out that the granting of a right of access is provided in the Immovable Property Law, Cap.242, article 11A and as far as its nature is concerned, it is not the object of independent ownership of a land. It held that the right of access, as an easement, by its very nature, does not deprive the owner from the possession of the servient land; also, it does not prevent a third person who, by virtue of a recognised and legitimate right, exercises such a possession or even exercises the right of free access thereof, after authorisation by the owner of the servient property, provided always that the exercise of the right of access existing for the benefit of the dominant property is not obstructed. Therefore, the construction of an entrance by the owner of the dominant property on part of the servient property covered by the right of access was unacceptable, not based on his right of access. Hence, the Court of first instance correctly issued a demolition order.
With regard to the order for the demolition of the wall up to 30 cm above the height of the asphalt surface, the Supreme Court repeated the case-law, stating that the construction of works following the granting of a right of access through the servient property to the benefit of the dominant property does not constitute trespass or unlawful interference and it is permissible to the extent that the right of access can be exercised with comfort and safety. However, the Court of first instance concluded that the access or its use by the owner of the servient property became impossible based on photographs that alone did not lead to safe conclusions in respect to the required height of the wall and they did not constitute solid and acceptable evidence. Therefore, for this particular issue, the Supreme Court ordered its re-trial by the Court of first instance.
The purpose of granting the right of access through the property of a third person is to provide access to an enclosed property for agricultural, residential or any other development. This right can only be abolished when the purpose of its granting ceases to exist, such as the construction of a road on the side of the dominant property, making the access redundant.

33 migrants found walking by police – entered through dead zone
Thirty three migrants were found walking between the villages of Limnitis and Pyrgos after having entered the Republic from the Turkish-occupied north on Sunday.
According to CNA, the people reached the area by boat.
They were first spotted by a coast guard vessel in international waters. After they got off, police spotted them and and took them via bus to Polis Chrysochous station.
They are believed to have paid €3,200 each to be transported to Cyprus from Turkey.

Labour minister highlights care for the elderly
A total of €334,000 was given by the ministry of labour for the financial support and partial operating costs of nine voluntary organisation in Paphos during 2017, the minister Zeta Emilianidou said on Sunday.
She also referred to five programmes that operate in Paphos that offer services to the elderly on a daily basis, which is only made possible because of the voluntary work of members of Non-Governmental Organisations. She was speaking at the 10th Regional Event of Elderly Centre in Paphos.
In her speech, read out by Paphos Regional Officer of the Welfare Department Lydia Koutsidou, the minister said the ministry works on issues of social policy to improve the lives of the elderly in a safe environment that helps them retain their independence.
She said that the welfare of the elderly will continue to be an important part of the mionstry’s policy both through its own schemes and working with voluntary organisations.

Heavy rain and hail have been falling in Nicosia since midday with the fire service called out to deal with problems.
These included opening up drains and moving cars from flooded streets.
The heavy rain has particularly affected Strovolos, Engomi and Nicosia within the walls it said.
First Meteorological Officer at Larnaka Airport, Mathaios Papadakis told CNA that the rain was caused by the instability that affects the wider region, mainly Greece and Turkey.
Meanwhile, a number of individuals have taken to social media to post videos of the downpour and hail.

Upgrades underway for Larnaka beaches
Upgrades are underway for next summer in Larnaka, according to a press release by the Larnaka Tourism Board.
In particular, the municipalities of Larnaka, Pervolia, Voroklini and Pyla – in cooperation with the LTB – are creating a project to offer citizens and tourists a complete day out at the beach.
“Aside from the ongoing work of ensuring the sands and sea are always kept in their award-winning condition, the upgrades will include children’s playgrounds, outdoor fitness equipment and beach sports courts (tennis and volleyball) added to various organised beaches.
“And with the majority of our most popular beaches also surrounded by food and drink establishments, and featuring water sport services in addition to facilities such as lifeguard, disabled access, restrooms and changing rooms, the new leisure and activity elements will give beachgoers something else to enjoy alongside the favourite pastime of sunbathing and swimming,” says the press release.

Stormy weather hits Nicosia
Storms, rain and hail hit various areas of Nicosia on Sunday afternoon in localised bad weather that also kept the fire brigade busy.
Starting from around 2pm a storm moved from the Kokkinotrimithia area towards the centre of Nicosia. The heavy rain, strong winds and hail of up to 2cm then moved away towards the occupied areas although the rain continued.
The fire brigade said it had been called out to a number of incidents caused by the intense weather.
Areas that were worst affected were Engomi, Strovolos, Lakatamia and the old town, the force said.
They were called out to open blocked drains and move vehicles from flooded streets.
On Monday the weather is likely to show a similar pattern, fine in the morning with rain, clouds and storms in the afternoon both in the mountains and inland. Rain is also expected on Tuesday afternoon.
